In the course of availing Happy Minds’s services, you may share sensitive personal data or information with Happy Minds. Sensitive personal data or information of a person means such personal information which consists of information relating to;—

(ii) financial information such as Bank account or credit card or debit card or other payment instrument details ;
(iii) physical, physiological and mental health condition;
(iv) sexual orientation;
(v) medical records and history;
(vi) Biometric information;
(vii) any detail relating to the above clauses as provided to body corporate for providing service; and
(viii) any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise:


Provided that if any of your above information is freely available or accessible in public domain then the same shall not be covered by this privacy policy.

Happy Minds shall use any sensitive personal information strictly in accordance with law and as permitted by you, and shall not disclose this information to any third person.

Your sensitive personal information which you disclose directly to the mental health professional shall be held in confidence by the concerned person.

Persons other than your therapists do not use nor access your sensitive personal information. We maintain strict firewalls and all our employees and officers are bound by confidentiality agreements and strict codes of conduct in this regard.

Our data and technology personnel may access information (metadata) that is automatically collected from you when you visit our website (such as geo location, time of visit, etc.) for the purpose of improving our services and performance. Such information is not used to identify you personally.

Information collected from you is stored on the servers of our service providers, some of whom may be located outside India.

Your personal information / sensitive personal information is collected with the intake form / any other form you may actively fill on our website. We do not automatically collect any of your sensitive personal information.

Data Retention and Data Deletion Policy

Happy Minds retains your personal information and sensitive personal information only for as long as necessary to provide its services, maintain appropriate business and clinical records, resolve disputes, prevent fraud, enforce agreements, and comply with applicable legal, regulatory, accounting, taxation, and professional obligations.

Account information will generally be retained for as long as your account remains active or as long as you continue to use Happy Minds’s services.
When your account is closed or you submit a valid data deletion request, your personal information will be deleted or anonymised from our active systems within 30 days, unless the information is required to be retained for a longer period under applicable law, for medical or clinical record-keeping, accounting or taxation requirements, fraud prevention, dispute resolution, legal proceedings, or other legitimate purposes.

Information stored in system backups may remain for up to 90 days after deletion from our active systems. Such backup information will remain protected and will not be used for any purpose other than system restoration, security, or compliance with applicable law.

Where complete deletion is not legally or technically possible, the information will be securely restricted, anonymised, or isolated from further use, except where its continued retention is required by law.

Anonymised or aggregated information that cannot reasonably be used to identify you may be retained and used for analytics, research, reporting, security, and service improvement.

Data Deletion Request Process

You have the right to request the deletion of your personal information and sensitive personal information held by Happy Minds.

The email address or mobile number associated with your Happy Minds account;
A brief description of the information or account you want deleted; and
Any additional information reasonably required to locate and verify your account.

For security and privacy purposes, Happy Minds may request reasonable identity or account verification before processing the deletion request.

After receiving and verifying your request, we will delete or anonymise the eligible information from our active systems within 30 days. We will notify you once the request has been completed or inform you if certain information must be retained due to applicable legal, regulatory, medical, accounting, taxation, fraud-prevention, dispute-resolution, or contractual requirements.

Submitting a deletion request may result in the cancellation of your account, upcoming appointments, subscriptions, access to reports, assessments, consultation history, or other services that depend on the deleted information.
